Scottish Government are seeking to engage with ScotlandIS members to gather insights and feedback on how best to implement changes to their Model ICT procurement contracts. Your input is crucial in ensuring that the adapted terms are practical, effective, and considerate of the needs of both purchasers and suppliers in the public sector.
The Model ICT Terms is a resource that anyone in the public sector can use to get content for their ICT procurement contracts. They are not mandatory, but rather to support those creating contracts by providing example terms they can adapt for their own purposes. Currently, there is a lack of content in the terms about data management, including standards and access needs. This can result in considerations for data management becoming afterthoughts once systems are procured, which causes confusion for both purchasers and suppliers.
The Data Division in Scottish Government is proposing to adapt the Model Terms to include more content on data management for organisations across the public sector. These changes work alongside initiatives to improve data management and use of standards in specific domains, such as the new Health and Care Bill. The additions to the Model Terms aim to support those to comply with legislation in this area. We would like to engage with suppliers to understand how we can best make these changes, considerate of your needs.
